Well Setback Bill Approved | Video

State representatives also approved a bill relating to how close oil wells can be placed near homes. The bill requires that unless there are extenuating circumstances, the Industrial Commission should not approve any wells within 500 feet of a residence.

And for any oil well within 1,000 feet of a home, the flares, tanks and treaters must be placed on the opposite side of the well, farthest from the home.

Representatives say this is just one of many energy bills they`re proud to pass through so far.

"Both sides moved a lot, gave up a little bit. But it was really for the benefit of this state and the industry going forward," said Representative Mike Nathe (R) from Bismarck.

The bill also requires that landowners be notified before a well is built if they live within 1,320 feet of a proposed site.
